Terms of Service

IMPORTANT: Please read these Terms of Service ("Terms") carefully before using the Pure Bite mobile application ("App") operated by Alexander Ryakhin ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using Pure Bite, you agree to comply with and be bound by these Terms of Service. If you disagree with any part of these terms, you may not access or use the App.

2. Description of Service

Pure Bite is a mobile application that provides recipe discovery, search, and management services. The App allows users to:

  • Browse and search for recipes
  • Save favorite recipes locally on their device
  • Create and manage shopping lists
  • Access recipe information and cooking instructions

Recipe data is provided through third-party services, including but not limited to the Spoonacular API.

3. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that:

  • You are at least 13 years old
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • You will not use the App for any illegal or unauthorized purpose

4. User Accounts

Pure Bite does not require user account creation. All data is stored locally on your device. You are responsible for maintaining the security of your device and any data stored on it.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App in any way that violates any applicable federal, state, local, or international law or regulation
  • Attempt to gain unauthorized access to the App, its servers, or any connected systems
  • Interfere with or disrupt the App or servers connected to the App
  • Use any automated system, including "robots," "spiders," or "offline readers," to access the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove, alter, or obscure any proprietary notices on the App
  • Use the App to transmit any malicious code, viruses, or harmful data
  • Impersonate or attempt to impersonate another user or entity

6. Intellectual Property Rights

6.1 Our Rights

The App and its original content, features, and functionality are owned by Alexander Ryakhin and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Recipe Content

Recipe content, including but not limited to recipe names, descriptions, ingredients, instructions, and images, are provided by third-party services (such as Spoonacular). These materials are the property of their respective owners and are subject to their own terms and conditions.

6.3 User Content

Since all user data is stored locally on your device, we do not collect or store your personal recipe collections or shopping lists. You retain all rights to any content you create or save within the App.

7. Third-Party Services

The App uses third-party services to provide functionality:

  • Spoonacular API: Provides recipe data and information
  • Firebase Analytics: Provides anonymous usage analytics
  • Apple App Store: Distribution platform

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

8. Disclaimers

8.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Recipe Information

We do not guarantee the accuracy, completeness, or usefulness of any recipe information provided through the App. Recipe content is provided by third parties, and we are not responsible for:

  • The accuracy of recipe ingredients, measurements, or instructions
  • Allergen information or dietary suitability
  • Nutritional information accuracy
  • The safety or quality of recipes

8.3 Cooking Safety

You are solely responsible for:

  • Following proper food safety practices
  • Checking for allergens and dietary restrictions
  • Ensuring ingredients are fresh and safe to consume
  • Using proper cooking techniques and equipment

We are not liable for any illness, injury, or harm resulting from the use of recipes found in the App.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ALEXANDER RYAKHIN, HIS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the App
  • Damages resulting from any conduct or content of third parties
  • Damages resulting from unauthorized access to or use of your device or data

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESSING THE APP, OR $10.00, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless Alexander Ryakhin and his affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with:

  • Your access to or use of the App
  • Your violation of these Terms
  • Your violation of any third-party right, including without limitation any intellectual property right or privacy right
  • Any harm or injury resulting from your use of recipes from the App

11. Service Availability

We reserve the right to:

  • Modify, suspend, or discontinue the App at any time
  • Change, update, or remove features without prior notice
  • Limit access to certain features or content
  • Terminate or suspend your access to the App for any reason, including violation of these Terms

We do not guarantee that the App will be available at all times or that it will be free from errors, bugs, or interruptions.

12. Data and Privacy

All user data, including saved recipes and shopping lists, is stored locally on your device. We do not collect, store, or transmit your personal recipe data. For information about how we handle analytics and other data, please review our Privacy Policy.

13. Updates to the App

We may release updates to the App from time to time. These updates may include bug fixes, new features, or changes to existing functionality. You agree to install updates to continue using the App effectively. Updates may be subject to additional terms and conditions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date at the top of this document
  • Providing notice through the App or other reasonable means

Your continued use of the App after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App.

15. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

You may stop using the App at any time by uninstalling it from your device. Uninstalling the App will delete all locally stored data, including saved recipes and shopping lists.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Alexander Ryakhin operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be resolved in the appropriate courts of that jurisdiction.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and End User License Agreement, constitute the entire agreement between you and Alexander Ryakhin regarding the use of the App and supersede all prior agreements and understandings.

19. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

21. Acknowledgment

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
